There's still one dark cloud on the horizon. While SNDK doubtless has key patents, it is still possible to sell at least some types of flash memory that don't infringe on SNDK patents. With developments in the technology coming at a very fast pace, it is altogether possible that flash memory will become pretty much a commodity in the next four or five years. As the commoditization grows in importance, the profits will go to the lowest cost producers, and the intrinsic value of some of the patents will drop.

It is not clear to me whether SNDK really has a tight hold on key patents. The LEXAR patent suit becomes ever more important as a test of these patents, as Lexar's products are closer to SanDisk's in terms of design and performance than almost anyone else's. I think it would be very helpful if SNDK issued a sort of score card, showing which companies are paying royalties, and in connection with which products.
