Ray - the 30 and 42 mb/sec rates cited in the Toshiba data
sheet are in fact the raw, physical bit rates for 64 and
256 QAM respectively and are standard for the downstream
on any compliant modem. This doesn't include error correction coding or framing overhead.

Head to head tests show much lower speeds, though I do not know
why there should be significant variations if all modems are compliant!
(I can imagine reasons, but don't know for fact which ones are at play.)
