The projections that IDC will collect large royalties from this arrangement would only hinge on the possibility that CDMA2000 becomes the platform of choice among all users in the world. This is clearly debatable and there is nothing in the current stream that would imply otherwise.

While I agree that the 3G platform of choice is still very much up in the air, I think the terms of the '94 agreement are probably important to IDC's ability to collect royalties on CDMA2000 or WCDMA although I agree the term "IS-95 type" would appear to apply more certainly to CDMA2000 than to WCDMA but it would be premature to assume that "IS-95 type" does not apply to WCDMA because we have not seen the actual contract or the specific language used which defines the scope of Qualcomm's use of IDC's patents.

Lacking the exact language we can only make an educated guess that Qualcomm's rights do extend to 3G based upon the "less than 10MHz" statement. Do you have convincing evidence otherwise and, if not, do you retract your statement from the Daglish website that claims this agreement only applies to IS-95? Please clear this up using plain and simple english.

Sincerely,

Bux
