Howard, I'm not sure on what source you base your conclusion, but I believe you're referring to the following from the now infamous press release:

This means that BD wants Quidel to stop selling these tests until the matter is settled. Unless Quidel's caught holding some sort of "smoking gun," or is completely incompetent in their response, such a court order is unlikely to occur. This sounds more like your typical legal tough-talk posturing on BD's part to intimate Quidel into settling.

Of course, I'm betting that this dispute is not as cut-and-dry as BD would want us to believe. We need more detail before panicking further or settling back and waiting this out.

If you have any more detailed information on this lawsuit, I'd appeciate a pointer.
