Antitrust Issues -- Let's cut the hysteria and focus on facts!

It seems people are getting pretty paranoid around here about antitrust issues. Agreed, DOJ may be the cause of some justifiable paranoia, but lets look at the facts.

1. Please show me a news article that provides at least one legal authority discussing this issue. ANYONE can write an article entitled "Checkfree MAY hear from Trust Busters". Without some legal authority, the article should be considered no more than a journalists/business analysts opinion.

2. True, DOJ finally caught up with Microsoft, but look how long it took! People became multi-millionaires before this occurred. Given our early in to CKFR, we could be in the same boat by the time DOJ ever finds anything on CKFR -- and there is no evidence today they will. And look at the charges that brought down Microsoft. There were serious manipulation tactics by senior management at Microsoft. As far as I know, Checkfree management isn't doing anything like this -- I doubt they would make the same mistake as Microsoft. Where's the evidence of CKFR antitrust behavior?

3. And believe or not. It is not illegal to have a monopoly. What is illegal is the use of unfair trade practices to get the Monopoly status and maintain the monopoly. Here too, where's the evidence of antitrust behavior?

4. Monopoly???? How can you claim CKFR has one, when its difficult to even calculate what the market is? It is hard to make a monopoly argument in a fledgeling market. It is way way to early to be talking monopoly, let alone antitrust. Additionally frustrating the monopoly argument are the other players in the market.

I don't see a concern of the DOJ seriously stepping in. If they do, they will probably act like Pontius Pilot and say, "why should we crucify CKFR, what have they done wrong?".

The only antitrust concern of merit is the fact that anyone can bring a law suit. But this is a vulnerability of just about any company at any time. A frivilous antitrust lawsuit against CKFR could, nonetheless, hurt CKFR if it came from a large body like the SPECTRUM consortium. But I argue the harm could be squelched if the antitrust debate focused on fact and legal analysis. This non-factual antitrust hysteria is pointless!!
