That's an interesting question. But whatever it is, it only applies if you leave it up to the broker to make the decision. I think you should consider first and take matters into your own hands. I would exercise the 40 calls. 42.5 are a close call. It depending on your your cash, margin situation, and how strong your stomach is.

You have a right not to exercise an option, even if it is in the money.
