I don't think that it will continue to be as clear cut as you suggest. Maybe it is now, but things are moving very (well, kinda, at least) fast.

There are several different domains to consider. If the ISP simply demands an exclusive, full time swath of bandwidth (NTSC 6 MHz tailored for digital data delivery in the format which is consistent with typical Internet services, only) then their argument would be considered a shallow one in a court of law, IMO. On that basis alone, they would lose.

But what about when the MSOs begin delivering in earnest their own digital TV channels which are now being made available at the upper end of the spectrum, where the MSOs themselves have earmarked as interactive services?

Once the MSO opens the door to interactive, then others who also occupy the digital idiom can also seek comparably efficient arrangements. And here, the law would tend to side with the encroachers.

Perhaps the gap between MSO digital and ISP digital is still too wide at this time, but the gap will narrow until eventually the differences will be deemed arbitrary, at best. While it would seems to me that this should only be a matter of time, the MSOs may have different ideas. I'm just offering speculation here about what I think would take place if technology were allowed to evolve at its normal pace. Of course, technology could be retarded from reaching natural growth levels for any number of reasons.
