Bruce, while I'm not inclined to call it a "panic play" by the shorts given their triumph of late, I think you may be right about it being one last push down before earnings. Shorty is plausibly involved.

The best time to mount this frivolous lawsuit would have been after the CC, where there would have been more straws to grasp at.

The fact that the stock didn't crack open further after these annoucements and a down NASDAQ suggests most weak hands may have been scared out.

I sold of the majority of my holdings over the past two weeks, but that's because I was foolish enough to be overweight the stock notwithstanding its lousy technical performance and massive uncertainty. I will keep a long-term core position at least until after the cc.
