Has anyone considered (I know I haven't) that TPJ could turn out to be the MSFT's biggest "friend of the court" in this whole case. TPJ has made it clear that he would like to see a settlement. So far both sides are acting like they have royal flush in a poker game. TPJ on the surface made it appear as if he was anti-MSFT from the very beginning, probably in hopes that MSFT would fold its hand agree to settle. I'm beginning to think the TPJ was trying to call MSFT's bluff but MSFT is turning out to be a pretty good poker player. TPJ is bluffing so good that now he's got the DOJ and AGs thinking they can't lose. In effect TPJ has backed himself against a wall. He probably knows that he will be overturned on appeal albeit 3 years from now. So my guess is he will impose remedies far short of what the DOJ and AGs are asking for. He may have played hardball but when it comes time to sh!t or get off the pot, I say he gets of the pot. My question is if TPJ imposes some type of behavioral restrictions on MSFT which would undoubtedly have Klein & Co. throwing temper tantrums like 2 year olds, what recourse does Klein & Co. have? Would they just have to live with the remedies that TPJ imposes? Is there any type of Appeals process for the DOJ/AGs?
