P.S. NOTES FROM THE FRONT: the Mountain is stirring ... may be somewhere in the vicinity of Nashville. We also may not have to wait til May 8 to have a day in court. The phone calls to the new CEOs, whoevr they may be, have worked. They were literally flabbergasted at the intensity of the market action today ... there were long faces at the end of the day and self-doubts as to whether they have gone too far has begun to set in. This is by far the largest operation the dept. in Tenn. has ever undertaken and they just don't seem to be finding anything which would justify it ... legal opinion is beginning to weigh in that ramping the action up the ladder to the public company itself may have been a problem ... actually began asking today if the company had any 'marketmakers'... were surprised to find it had more than a dozen ... did not at ALL understand what damage they had done by letting the shorts cover ... something they'll NEVER be able to fix ... they thought the stock trading was all done by Mohamed buying back and forth, etc. etc. The calls to the attorneys general reinforce this ... if you're still a shareholder, letting up tomorrow or the next day or the next is something you NEVER want to do at this point ... you have to intensify the pressure. The message is clear: if there's a CEO, whoever it is, have him or her come out of hiding and quit hiding behind PR depts. and 'press releases' ... let them know that we as shareholders expect our CEO to answer hard questions about what happened to the price of the stock today ... and if it was a real CEO we would be riding him or her out of town tarred and feathered ... also, the Conservatore is covered in the document by it saying she does not have to have a bond ... she is 'protected' by the Attorney General. Someone should suggest that she may not be 'protected' from shareholder liability suits and she certainly can not stop them from being filed ... and a friendly word that she should, for her own preservation, get her OWN independent, personal lawyer. Jean and Co. has also today begun asking for the first time whether the CRIC sale might not have been allowed to happen. As conservatore she is empowered to effect mergers and acquisitions and if you want to 'influence' her to let the sale happen, feel free. They also are beginning to understand that after the sale, GIFS would have been even stronger if they had waited to try to lock up GIFS assets ... there would have been an extra million ... also the sale documents are beginning to show them that the buyers were taking adequate precautions to insure the integrity of the protection of any liabilities which may have come ... including those matters they were trying to protect. And finally, it appears that the states involved as having 'actions' against GIFS or CRIC may indeed have been in the Edgar documents ... and what the papers filed by the State don't show is that, our understanding is, that it is believed all of those actions were 'resolved' between GIFS and the states involved. The stamp of Elrod, Mohamed's nemesis and the guy who may have been 'paid off' to get at the assets of the broadcaster who is bonded by GIFS, appears to be all over this action, and Jean & Co., if anyone can get to them, should be asked if Elrod is 'using' them ... and whether their protection by the Attorney General covers them should it be shown later that they are unwitting accomplices to a conspiracy by a bureaucrat who may have an agenda for which there is an illegal payoff, political or money or otherwise, or via a private vendetta. Hopefully this is enough new ammunition to keep the questions going. We also want to ask them to have a conference call and explain to us shareholders their plans for the company and its subsidiaries ... what's up with American Lift ... are they proceeding at the mine ... how's the Pace Car division coming ... are they shoring up IMXS? Come on, Jean, what's happening!?

Finally, guys, we haven't heard directly from the Mountain yet, but ... we may yet tonight ... and meanwhile, don't be surprised to see the 'mother of all press releases' issued by Himself tomorrow morning. This movie ain't over, and the best part is, we all get speaking roles <g>. Keep those phone numbers handy and ask a few questions at a time, then call back and ask some more? The fat lady could step to the microphone at any time, but right now she doesn't even seem to have arrived at the building yet. |
