My point was that even if their intent was to do damage control, it certainly will not have that effect. If their "insignificant" statement turns out to be wrong, any plaintiff's attorney will jump on the "inconclusive" statement as back-pedaling and as a virtual admission they were wrong. If their "insignificant" statement turns out to be correct, then a whole new class of plaintiffs will emerge who will sue FCX because they bought Bre-X logically construing his "inconclusive" statement as back-pedaling and relying on it as an indication that there really is gold. Whether the latter class has much of a case is iffy, but it won't stop a class-action attorney from trying.
