I agree. Unfortunately, Toshiba's willingness to cave emboldened the greedy s.o.__. lawyers. Why did Toshiba settle? For probably lots of reasons not the least of which is a japanese culture of litigation aversion. It is a well settled principle that japanese corporate defendants are much more willing to settle than proceed with a long, costly and protracted legal. As a general statement they absolutely despise litigation and will avoid it at almost any cost.
