I've been trying to figure out why the stock has been so strong during the rise rather than doing it's usual run-and-fade. My ASIC-designing friend and I have come up with some conspiracy theories we'd like to share:

Conspiracy Theory #1: Hitachi knows that they're going to settle the case. They figure "what the heck, we might as well get someone else to pay the royalties and penalties" so they start buying RMBS knowing that when they do announce a settlement, the stock will skyrocket. They can then unload during the stratospheric run-up and pay Rambus the royalties with profits on Rambus stock! Poetic justice, I'd say.

Conspiracy Theory #2: Take theory #1 and extend it to all the memory manufacturers in the market (since they all know that Hitachi is going to settle). Heck, if they conspire well enough, they might end up owning a controlling share of Rambus. Wouldn't that be a kick!
