<...A post-trial hearing was held on April 30, 1997, but no decision had been rendered at the date of this Report. There can be no assurance that the jury's verdict will be upheld, and any judgment may be subject to appeal by either party....>

Relative to your question on the equitable defenses, Dragonfly (post 2731) summed up the situation as best as it can be at this point. We know so little (in fact nothing) as to the nature of what Mitsu's proposal's are that it is impossible for us to speculate regarding any possible outcome. However, it appears that something should be forthcoming soon since a hearing was held yesterday. On the other hand, it could linger on for sometime yet. One never knows for sure in these matters.

Relative to the 10Q Report and the seemingly discouraging news on KM in MR heads. I don't view the statements made in the 10Q as necessarily disheartening. My take on the statement is more along the lines of the obligatory disclaimer, which seems to fit with the company's conservative personality. I don't think this switch by the data storage industry has caught Ampex off-guard. Obviously they have already done a lot of work with KM in MR heads and that work has shown some promising results.

In fact, IMO, they are quite right to take this approach until they have some actual field production results with KM used in MR. Anything else at this time would be hyping based on incomplete data and testing. I know some would prefer more hype, but if it ultimately can't be backed-up with facts, it is worse for the company and the stock price.
