Anything is possible, though banks generally don't play the reverse merger game. They may just take their portion of the cash and call it a day. The 10-K also says:

"No specific transaction of the type described in the preceding paragraph has been proposed or agreed upon by the parties, and it is uncertain whether or when such a transaction will be proposed, agreed upon or consummated. Furthermore, there is not yet any agreement or understanding regarding the price that stockholders would receive if the parties decide to proceed with the transaction."

It has been almost a year since Regency filed the 10-K and my guess is that the recent run up might be in anticipation of some updated disclosures when they file at the end of the month. Probably a decent gamble, but I wouldn't bet the house. I will keep my eyes open for the 10-K. If I miss it, please let me know what happens. Thanks.
