LPS5, you are wrong. I am not embarrassed about our previous discussion, I just didn't want to argue with you further. I do not believe that I was mistaken in my previous argument wrt to shorting and margin accounts.

The point in my initial post was that the Nasdaq rule and the NYSE rule are different. We agree on that. How you refer to them is semantic.

I shorted MCLL at 10 last month, after the bid/ask dropped from 10 1/16 x 1/8 to 10 x 10 1/16. You are mistaken on this issue. There is no bid test rule on Nasdaq Small Cap stocks. You are also mistaken in your example of the bid test rule for Nasdaq NMS stocks. The fact that the spread is 1/32 is irrelevant. The ask is irrelevant. The short must be at least 1/16 above the bid if the bid is lower than the current bid.
