Yes, she would, if the effects of her actions are predictable and she had no compelling reason to take the action leading to the effects. Sometimes the law recognizes such culpability, sometimes it does not, but leaves it to informal censure.......I may have a general right to trash my property, but it can be limited by the harm done to adjacent properties. If I do something that may cause an accident, and which a reasonable person would refrain from, I am held liable for the accident..........
