Rambus patents and DDR

I've looked quite carefully at the Rambus patent, and I think I understand the basis for the claim that DDR infringes it.

Rambus claim as their invention the attachment of a bank of 2:1 multiplexors to a data pin of a memory chip such that the output of two different memory banks are routed to the data pins, one when the clock is low, the other when it is high.

I don't see how one could build any kind of double data rate memory device without such a multiplexor. It's a pretty broad claim, but if it is upheld in court I don't think DDR can work around it.

A few months ago Geoff Tate said they were waiting for DDR samples before they knew if it infringed. I think they needed to dissolve the packaging and put the DDR silicon under an electron microscope to know for sure. It would be easy to see if the multiplexor banks were present by doing this.

Of course if a workaround can be found, Rambus still has a good case for damages on what's already shipped :)
