Wait a second. Every processor whether an "ES" unit or not is marked right? In fact the rumors about the "ES" units hitting the market mention engineering markings on the processor card don't they? Further the processors are marked not just on the casing but even on the die itself? And I would have to assume that Intel records those numbers before they send them out to a customer, especially for engineering samples shipped out under NDA. So it would be very hard for a customer to be selling engineering samples without Intel's blessing or at least without Intel turning a blind eye because Intel could find out which processors were leaking out and track them to the exact OEM that they originally sent them to. If the customers were breaking NDA with those chips I am sure that Intel would be on them like a pit bull therefore I find it hard to believe that those chips are hitting the market without a certain degree of Intel complicity. Am I wrong in my assumptions that these processors are marked and that they can be tracked back to the customers that they were sent to for testing? because if I am not wrong in those assumptions then I fail to see how Intel is not guilty in any shipment of engineering samples. They are allowing it to happen despite having all the means necessary to put a decisive end to it.
