Any discussions involving Alcatel with the Justice Department have been to provide factual industry information requested by the Justice Department. Krish Prabhu, Chief Operating Officer of Alcatel Telecom stated, "We value the relationships we have developed with both JDS Uniphase and E-Tek and have been in discussions with them to ensure that Alcatel's long term interests will be protected. We look forward to continuing good relationships after the merger is completed.

Now, that's an interesting development - Alcatel releasing a statement that it "looks forward to continuing good relationships after the merger is completed." It is becoming increasingly clear to me that Alcatel is posturing and looking for continued favorable pricing.

I continue to believe Alcatel's concerns can be managed and, based upon Alcatel's statement, the initial reaction to Alcatel's "complaint" was either inaccurately portrayed or has been quietly addressed by JDSU/ETEK.

Parenthetically, I wonder if the initial quoted remarks of Paul Harrison, Alcatel's USA Vice President of Product Strategy, were inappropriate. The new statement was issued by Krish Prabhu, COO of Alcatel. Did Harrison speak out of turn?

I would expect a statement from JDSU/ETEK to be released to further clarify this matter.
