You are right of course that the little people can get shafted. However, the point I was trying to make was that a decision based on due diligence is probably better than one made based on stories like Bloomberg's. No question, DD has to be revisited as new information emerges - but that doesn't mean I toss out my previous DD.

In the case of ETEK, my personal belief is that it would be foolish for Justice to block the deal. This technology is evolving so quickly that the advantage gained by JDSU in merging with ETEK will be finite - my guess is 18 months.

At some point, if the market forces are strong enough, another player **will** emerge. Whether that player is SDLI merged with whomever, a Nortel spin-off or a Japanese company, who knows. The only thing that I think is certain is that a player will emerge and that should be enough to satisfy Justice.

I also do not believe Justice will do anything to disadvantage an American company in favor of foreign companies or in favor of permitting a significant foreign competitor to emerge.
