If the remedy is serious and involves irreversible actions, such as break up or code publication, the harm is "irreparable" and unless the court is willing to say (which is appealable) that it is impossible that Microsoft can prevail on appeal, the court in its discretion must grant a stay. If it does not, the refusal of the stay can be appealed and the Court of Appeals will review the failure to stay. You understand that the whole Microsoft prosecution is a Democratic political play, which is likely to be dismissed, settled, or intentionally lost if Bush wins (just as the IBM antimonopoly case was dismissed by Reagan's DOJ 13 years after Nixon's DOJ filed the case).
