Yahoo! to be regulated as a mutual fund! NYTimes and WSJ report that Yahoo!'s investments, particularly its 34% stake in Yahoo! Japan have shot it well past the 40% threshold that the SEC allows for a company to hold in investment assets (as opposed to operating assets) before being stiffly regulated as a mutual fund according to the Investment Company Act of 1940.

Softbank owns over 50% of yahoo! japan, but I can't determine exactly how much?? Can Softbank sell enough of its stake to Yahoo! to raise Yahoo's stake from 34% to 40%, thus getting YHOO off the hook??? what else can yhoo do if their appeal is denied by the SEC? Buy eBay? :P
