I don't know the law verbatim, but as I understand it, a company may comment on earnings at any time, although companies may, as a matter of choice, refrain from commenting. I believe that the official "quiet period" refers to IPOs, and I think (although I am not sure) that a company and issuing brokers must refrain from any comments for a <edited here> 25 day period following issuance.
