Actually, what he described was a bribe between a floor specialist at the NYSE and a fund manager.

"How much is it going to cost me to move this stock up two points?"

"I can do it for 70,000 shares" replied the specialist.

Thats not a breach of fiduciary duty, that's breaking securities law.
