It IS silly. The time and resources being put into this could rescue dozens of kids in this country who are far worse off than Elian would be if he were returned to Cuba, especially now that he has the status of a folk hero down there; you can bet he'll be treated well upon his return.

I think there should be (and probably already is in the law) a strong presumption that a child's interest is best served by being with his/her parents. How would all these protestors respond if the tables were turned and a U.S. citizen child somehow turned up in Cuba with his extended family while his father remained in the U.S. (and to make things even more parallel, assume his Cuban family is among the elite, while his U.S. father is dirt poor)?
