Craig, That Mike is amazing. He was all over those court transcripts... ...like a bum on a bologna sandwich. Lexar Media would do well to update the registration statement as follows... "We recently reached an amicable agreement with SanDisk whereby an industry standard licensing fee will be paid for intellectual properties we have incorporated into our CF assembly technology. Similar arrangements have already been made between SanDisk and other industry leaders such as SSTI, another manufacturer of the CF card. By settling the dispute Lexar has avoided ongoing legal costs and potential treble damages that may apply should the dispute have gone to trial. In addition, the spectre of an impending injunction has been lifted. We are satisfied that the current arrangements will facilitate our ongoing efforts to produce CF cards of the highest quality. Indeed, potential delays in product release have been avoiding by eliminating the need for discovery of patentable techniques which side-step SanDisk's broad IP. In return for this consideration we have also dropped all countersuits filed against SanDisk, a further indication of our willingness to procede on the best of terms with our fellow competitors in the flash memory arena. It is our feeling that the consumer demand for removable flash memory products will be large enough to accomodate several successful companies and that our current enhancements such as direct USB connectivity and the fastest write speeds currently on the market will distinguish our products from other competitors."
