An analyst on CNBC yesterday (I do not recall his name) said that if the judge issues a ruling and the talks break off, this (in his opinion only) would be a cause for MSFT stock to lose ground (He said immediately about 10 points.) He then went on to state, on CNBC, that there would be lawsuits filed by those who felt damaged by MSFT which would create another negative for MSFT even though they would be reversed if an appeal was won in a year or so. I share this opinion since Judge Jackson has encouraged settlement and has stated his position which would be against MSFT. His remedy would be harsher than a settled remedy.

Now the big question is: How does this play out fot SUNW? I believe since SUNW was one of the injured parties (JAVA being altered) and the opposition in the past to MSFT by the two companies models (one open standard vs. MSFT proprietary standards) IMO this would be a positive for SUNW, AOL (which owns NSCP)at least.
