If there's a MSFT victory on appeal, how would this ensue?
I am not a lawyer, so I don't know. However, I would guess that a ruling against msft would open the floodgates to lawsuits that would be proceeding while the appeal process was going on. That could take years. I doubt if the market would wait around to find out who wins in the end, with so many other companies to invest in that are not tied up in lawsuits. The only ones who are going to make any money, and it will be a bundle, are the lawyers.
