I think you are completely onto something here. Your insight is valuable.

MSFT must attack the procedural aspects of the trial in order to set aside the findings of fact and avoid those findings being used against MSFT in private litigation. The limitation on 12 witnesses is the most obvious procedural attack.

Simply overturning the ruling on appeal is not enough. Microsoft cannot truly win on appeal unless it also sets aside the FF.
