Microsoft and JDSU in trouble

The antitrust issues surrounding both companies are bound to hurt these two today.

First, Microsoft: If Posner couldn't get Microsoft to reason with the government, the latter's strong hand WILL be played. As a former antitrust prosecutor, I feel quite confident that enforcement will ensue. The district judge in the case was kindly giving MSFT an out. They turned away from the "gift." The judge has bought the government's position "lock, stock, and smoking barrel." The judge will hand a break-up opinion to the Court of Appeals.

Second, JDSU: The government does not regularly seek documentation of mergers. It appears to be under the serious impression that the merger is monopolistic. JDSU/ETEK now have a heavy cloud hanging over them. HEAVY. Government evaluation of mergers is not done with due speed.
