Well, certain members of the BOD are no strangers to legal proceedings. In fact, the BOD is one of the most interesting aspects of this company. Interesting because its make up has potential for more than the usual corporate intrique. In looking at each director's bio, I find about half seem to have ties with Mr. Icahn (looks to me like they work for him). Yet he controls only ~25% of the voting shares, if memory serves.
What does this mean? I have no idea. Was the company formed this way? Is it positive, negative, or neutral? I don't know.
Do you have any thoughts on this subject? I may just have to try and dig up the history of KDUS, and how it came to be what it is now, but it may take a while.
My guess is that if KDUS wins against SIBIA, and sues for damages, SIBIA Merck might settle. This and news of licensing deals would produce just the kind of rallies BMS needs to sell into. I think my strategy will be to accumulate starting here. And watch the filings for my exit signal.
I still need to research the competition a bit, though.
