Mike: No doubt there will be endless legal wrangling. And while that wrangling is going on, smart MSFT employees will be heading for the exits. Can MSFT "win" on appeal -- probably not, but anything is possible. MSFT cannot "win" in the large sense.. this whole fiasco shows that their notion of "winning" does not work. They could have and should have smelled the coffee a year ago, but choose to bull right along. Let them say they have a "strong" case all they like.. they saw a bug on their foot and so they shot at it, missed and shot themselves in the foot. Now the bug is making its way up their leg and they keep firing away, hitting themselves again and again. The bug is headed for their face and they are reloading -- I don't call that smart.
