(OTCBB:SGGNF - news) announced last Thursday Sungold received a court opinion issued by the Eaton County, Michigan Circuit Judge Calvin E. Osterhaven, granting the Gun Lake Band's motion for summary disposition of the lawsuit filed against it by Sungold. Judge Osterhaven's decision appears to have been a reluctant one, because he stated in his opinion that ``public policy might favor waiver of abrogation of sovereign immunity to encourage commercial entities to do business with Indian tribes...' Sungold agrees with the trial court's decision for a number of substantive reasons. For instance, the Gun Lake Band was not recognized as an Indian tribe when it entered into its contractual agreements with Sungold. Therefore, Sungold intends to vigorously appeal this initial decision in Michigan's appellate courts, and it remains confident that it will ultimately prevail in this litigation.
