I believe that the Patent only covers removable Flash memory devices w/ built-in controllers encased in plastic. Also, the contact pins are mentioned in their configuration as well. The FLSH stuff is not removable to my knowledge.

Notice that Smartmedia does not have built-in controllers thus avoiding the Patent issue. But this is a rather severe limitation of Smartrmedia IMO.
