The trail is over, the punishment phase is next. The government wants some kind of admission of guilt and will not let up until they get it. The defendant at some point must consider the alternatives that will save the most money. A tiny apology would go a long way in appeasing the court. The government, whether right or wrong, is still in charge. MSFT's attitude towards them since the beginning has been one of contempt, and it's just making the DOJ more determined to prosecute.
