From what I understand the CDRH is intending on setting a new eye safety guideline, with a 2 tiered Class 1 category. The true Class 1 level is expected to be a VERY conservative classification meaning that the laser will be eye-safe no matter what vision enhancing equipment may be being used, the other is to be a Class 1x (I am not sure what the x will be) and this will refer to anything where a vision enhancing tool is not involved. This second category is likely where we will fall.

Having outlined the above scenario, I discussed this with our engineering staff and got the following response:
- if you were to walk up to the transmit lens, place your binoculars or magnifying glass or whathaveyou immediately against it and look in, there would be the potential for a negative impact on your eyes. If however, you are looking at the unit from up the street, thru a pair of binoculars, because you wanted to see what the funny little box on the roof was, you would NOT be in any danger of causing your eyes any damage. I was told you would have to be extremely close to be in any danger and looking straight at it.

For all intensive purposes, the ANSI and IEC standards are what will likely be adopted for the visually unaided version of the new eye safety regulations.
