<aren't the shares that have been bought back still available to vote? >

The bought back shares of SEG are retired and can not be voted. I asked my broker this question about 3 months ago and he put me in contact with SEG PR. SEG said the shares they bought could not be voted. I was wondering if share buy back was a defense for hostile takeover.

I disagree that the deal will go through although I wish you still had your shares to vote. I think the money managers of funds think alike and will all push for a better deal. If they can't get it from the existing management, they will try another means. They have the responsibility to their management to maximize the value of their holdings. The problem I see is that it will take leadership and time to get the majority of stockholders on board before they can negotiate with management. Still I would not expect to hear anything before tomorrows earnings report.

I hope you sold your shares to someone that will try to maximize their profits. Certainly a responsible BOD could get us more value or wait a few quarters until the sector is stronger and in demand.

Regards,
Mark
