The mother had custody of the child prior to her death so it wasn't kidnapping. To call it kidnapping is stupidity in itself. She had a home situation with Elian and her boyfriend. The father is married to another woman. It's questionable whether her intent would be to leave the child with Floriday relatives rather than her ex-husband in Cuba. They should expedite a custody hearing so that the issues can be sorted out. If she had left a will or some other legal document, this would've been spelled out beforehand.
