Reno asked the Court for an affirmative order telling Elian's great-uncle Lazaro Gonzalez to turn over Elian to Juan. The Court refused. Today's ruling was on a motion by the relatives to block Juan from taking Elian out of the US. I have not found a reference in any news source to a motion from the Govt to transfer custody. The Reno and the INS believe they have the authority to transfer custody without a court order.
