It is clear that the Court slapped Reno hard. They made clear that she has avoided following the law. They ordered her:

3) All officers, agents, and employees of the United States, including but limited to officers, agents, and employees of the United States Department of Justice, are ENJOINED to take such reasonable and lawful measures as necessary to prevent the removal of Plaintiff, Elian Gonzalez, from the United States.

To any sentient person that would mean that Reno is required to keep Elian out of the hands of those that would spirit him out of the country. That would mean that Elian must not be turned over to the Cuban agents via the father.

Even if Elian stayed in the US it's hard to believe that Reno would do anything to get him back after she lost in the Courts. So giving Elian to the totalitarians is the only way to win for her and Clinton and Castro.
