Rights of a 6 year old versus the rights of his loving father.

Let's compare the Elian case to that of a Jehovah's Witness.

Undoubtedly, many of us here heard on numerous occasions where a child dies from a "curable" illness because his parents, practicing Jehovah's Witnesses, refused treatment based on their religious beliefs.

Many times the courts have sided with the parents' rights in these cases. No matter how immoral, illogical or fanatical the situation was to most of us, the Courts found that the parents' rights superceded the State's obligation to protect the life of the young child. Time and time again the Courts rendered the same decision in several cases despite the fact that the child's life was endangered because of the parents convictions.

Although the Elian case is not one of religious conviction, it is no where near as detrimental to the child as a blood transfusion was in the cases cited above. As such, the Court will ultimately side with the father. It will be he who will ultimately choose their place of residence.
