An executive agency doesn't need a court order to tell someone to stop breaking the law. At least not under any "due process" definition I've ever seen.

Whose due process rights could have possibly been violated? You must have some right before it can be violated. The relatives had no right in Elian, therefore no due process violation.

So you would require the DEA to get orders telling drug dealers to stop dealing, or kidnappers to stop kidnapping or murderes to stop murdering?
