IF this is the case doesn`t this leave USRX with proprietary technology

It does, x2 is proprietary but easily upgradeable to any new standard implemented. The ROK camp is a mass of FUD, plain and simple. Lucent claims their Kflakes&reg chips are software upgradeable. Hayes and others who are using ROK Kflakes&reg claim their software upgradeable.
But if the chips are not then where does that leave someone like Hayes? It leaves them with an option they already exercised by offering x2 along with Kflakes&reg. x2 is in the lead by a large margin and every x2 modem being sold can be upgraded via software.
Here's a LU link, and LU is advertising in publications like Boardwatch that their chip is "truly" software upgradeable.
