OT: Au contraire to your Au contraire. The driver will successfully sue the maintenance worker at the plant that crushes the gravel for the tracks, upon which the unheard train rides, after it crushes his head and cracks his hearing aid.

The crushed head will win a breathtaking award because someone flushed a noisy toilet, causing a gravel crusher to turn his head to check out the noise. A small amount of gravel will be only partly crushed. This gravel was incorporated into the rail bed within 5 miles of the intersection and partly damped the acoustical signal generated by the train. Having one of the new digital (computerized) hearing aids the "head" picked up this minute frequency difference. Because there was no notice posted at the intersection warning of the possible variations in conductivity due to variables in the rock crushing process, specifically those caused by toilet noises, the "head" misread the distance to the hurtling train. Further, because MSWindows was used at the same plant and cause a computer to lock up about the same time no record was made of the mis-crushed rock.

The heirs of the crushed head will thus be able to tap into Bill Gates declining fortune. They better hurry though before another judge lays claim to the fortune and they miss out altogether.
