You are probably correct about the abuse allegations, but the standard is "best interest of the child", and although the presumption is strongly in favor of the nearest surviving relative, there are various allegations and issues to weigh. If the court deems it necessary to bring classmates to settle some of the issues, then I have no objection, frankly. I imagine that Elian will eventually be repatriated, and I am sorry too about the hoopla, but I cannot say that I feel comfortable ignoring the mother's intention, and not even visiting the question of whether a case for asylum can be made, before disposing of the matter. I am a little surprised that you consider it so clear cut. On the other hand, I have not followed closely.....
