Unfortunately for you the court of competent jurisdiction lies in Cuiba, and not in the US. Elian and his mother and father were all residents of Cuba. By his mother dying at sea, she never reached a competent court jurisdiction in the US to validate any claim that her custody might infer.

The right way to handle your argument is to return Elian to Cuba for adjudication and assignment of custody in the most competent court to determine his disposition. That would be the Cardenas, Cuba, Family Court or its equivalent.
