The public needs to be protected from the abuse of monopolistic power when it exists. In Canada we had a phone monopoly. One company operated the phones. That's changed, now there is competition and phone rates are down. MSFT is a monopoly, and they squeezed many firms to carry their product exclusively., That's not good for any market. In american or anywhere. "We have a tort system" Sure you do, but how does a small company fight MSFT when it chooses to abuse its monopoly position, it can't. It's naive to think that the tort system would work against a monopolistic giant like MSFT. That why MSFT was found guilty in the courts of abusing its monopoly position.
