Paul, People can have trademarks that have the same letters in different situations.
If Dupont has the Duron trademarke with a certain spe AMD cannot use that same shape, but must use a different shape of letters to say Duron. It must also be a different product, like paint or plastic film(Dupont) versus CPUs(AMD)

There are an amazing number of differthings wil the same letters as a trademark, but with different shaped letters and products.
In effect if the public is likely to be misled, then the prior TM will win any lawsuit if another company tries a similar mark in the same industry. You recall the Macdonalds lawsuits about hamburgers etc. Well a few stands beat Macdonalds use of the name and they were able to get a few bucks from the big M to go away. In new York you can register the same business name in each county and open up and sell stuff as a DBA. Bill
