I think at this point, Microsoft's chances on appeal are fifty-fifty. While I believe it hasn't done anything wrong, the pressure building against microsoft in the legal system is tremendous and difficult to ignore. Also, the lawyers seem to be weak also. The risk for the government is that this may get completely thrown out by the appeals court. I think even now it is best to settle for both the parties...
